These Terms of Service ("Terms") govern your access to and use of services provided by WestCosa Pool Care ("we", "our", "us"). We provide professional pool care, maintenance, repair coordination, and related services through our online platform and on-site visits. Service descriptions, availability, and pricing are provided on our site or in service agreements. All services are subject to these Terms and any additional agreement you enter with us.

2. Eligibility and Accounts

You must be at least the minimum legal age in your jurisdiction to create an account and use our services. You agree to provide accurate, current, and complete information when creating an account and to keep your account information updated. You are responsible for maintaining the confidentiality of account credentials and for all activity under your account.

3. Booking, Payment, and Cancellations

Booking terms, payment methods, and cancellation policies are provided at point of sale or in your service agreement. By booking services you authorize us to charge applicable fees. Payments are processed by third-party payment providers; you agree to their terms. Cancellation or rescheduling may be subject to notice periods or fees as set forth in the booking confirmation.

4. Use Restrictions

You agree not to use the service for unlawful purposes or to interfere with the operation of our platform. Prohibited conduct includes impersonation, submission of false information, unauthorized access attempts, transmitting harmful code, or using our resources to violate others' rights.

5. Service Terms and On-Site Work

For on-site services, you must provide accurate site access information and necessary permissions. Our technicians will exercise professional care but are not responsible for pre-existing conditions or hazards not disclosed to us. We may take photos for documentation; we will seek consent where required.

6. Disclaimers and Limitation of Liability

WE PROVIDE SERVICES "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. WESTCOSA POOL CARE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

Our aggregate liability for direct damages arising out of or related to these Terms will be limited to the fees paid by you for the specific services giving rise to the claim during the twelve (12) months prior to the claim, except where prohibited by law.

7. Intellectual Property

All content on our platform, including text, graphics, logos, and software, is owned or licensed by WestCosa Pool Care and protected by intellectual property laws. You may not copy, reproduce, or create derivative works from our content without prior written permission, except as expressly permitted for your personal, non-commercial use.

We may provide links to third-party sites and use third-party service providers. We do not control those third parties and are not responsible for their practices, terms, or content. Your use of third-party services is subject to their terms.

9. Termination

You may close your account by contacting us, subject to any outstanding obligations such as unpaid fees. Termination does not relieve you of obligations incurred prior to termination.
